I am examining this alternative. Anyone who has experience with this situation willing to share their opinions, advice from the lawyer, questions from the INS, etc.?

No, I've not seen any case like this. But know couple people who changed the title and position but continued the processing under the old title.

Cheers!

sankrit .... do u mean AC21 for change within the company to a NON similar field ...... or AC21 within the company to a similar field.

BTW....I do not have experience with either. But I would think that using AC21 for similar job should be OK.....within the same company or outside........But that's just a view :)

I was transfered to a different manager under same upper management. But, after consulting new manager and an old manager, old manager continued my process, and that worked.

My department was closed about a year and half ago and I took a new position with same company at same location (same field, similar job resposibilities) different title. I never have to file anything special just for this. I did inform our corporate attorney and they worked with my HR director. I think most companies are willing to work with you as far as how paper work goes. Hope this helps.

Thanks, everybody. I wanted to understand if the AC-21 similar job requirement can be interpreted to include positions of progressively higher responsibility within the same area. I work for a large multinational that tends to go by the book. They are very supportive, but I am not sure if I want to ask them to provide a semi-sincere RFE response tailored to meet the requirements of a potential employment RFE. Hence my interest in finding out whether I can make use of the legal bylanes offered by AC-21.:(
