Hi All,
I have been with my employer for 6 years now and I am stuck with PBEC. Applied thru PERM and got approved. Getting ready to file EB2 I-140. My job duties have changed more than 50% and I am applying for I-140 under EB2 using the experience gained with same employer.
My question is, has anyone tried going that route successfully? If so what do I need to watch out for? Any suggestions, advise will be greatly appreciated.
Thanks,
frog

I am not sure how they deal with I-140 using Labor from Perm. I filed EB2 Labor RIR from a company that I am working for the past 9 years. It took more than 5 years to get my labor approved. Rounds of Issues. They did not consider my experience at eh company. We were forced to change my Labor to EB3 Regular and aplly again. Finally Labor got approved after 5 years in EB3 Regular. Now My I-140 is stuck in Texas. I filed in Dec 05. People who applied in Mar/Apr 06 are getting approved. I am not sure if there is a issue with my I-140. I am not discouraging you but be careful and consult a lawyer.

Thanks for the reply

I guess I am about to find out. We didnt come across any issues at the PERM stage. Hoping to prove beyond any doubt about my change in job duties.
Did you file directly with TSC? or is your case one of the transfer cases. Seems like cases filed directly with TSC are getting approved much more faster than the transfer cases.
Anyways, thanks for your comments.

Friend of mine did that and he got approved. You might need to submit your tax documents (W-4) along with your I-140 for last several years.

Thanks vitale

Its good to hear that someone has tried that option successfully. I am a bit anxious, but very hopeful at the same time.
Will keep you guys posted on my journey thru the 140 world.
