Anybody out there with Priority Date in Oct-98 & ND Sep-99 having got FP notice. A friend of mine got it.
    A friend of mine whoose priority Date is Oct-98 and who happened to get opportunity to file his 485 application in Sep-99 time period when priority dates were current for EB3 category, filed his 485 application at that time. He has received his FP notice on 8.1.2000 from Vermont center. Isn\'t it unusual?. Does that mean he can get his GC much earliar than his other counterparts who have their priority dates between Sep-96 to July-98. Isn\'t it bit confusing as people with priority dates from Aug-96 to Sep-96 are still waiting for their FP notice then how a person with PD Oct-98 and ND Sep-99 can get a FP notice.
    Does that mean that GCs are not being processed in order of priority dates now?

Well the Fp notices are given irrespective of your PD being current or not as FP is a part of the I485 application. So everyone who applied in Aug99 and so on will get the FP notice whether their PD is current or not.
Now when they start processing the AUG 99 applications they will first sort out the applications as per category+ PD and at the time of processing if PD is not current then INS sends a letter to that person saying that I485 will not be processed as visa number is unavailable and it will be kept aside till that PD is current.
So say your friend\'s PD is oct 98 with EB3 and next month they start processing sept 99 RD/ND and at that time as per the visa bulletin the PD is not current then he will get a visa unavailable number and his processing will be put on hold till the date is current.And whoever\'s PD is current will get their 485\'s processed.

This is best to my knowledge and if anyone has better info please do post.................and always get legal advice on any matters.
