As the economy going south, more and more I485 waiters are laid off. Some of them, unfortunately, have not yet finished the 180 days, the life-line marked by AC21 law.
What now?
The AC21 law has yet to be finally implemented by INS. The June 21st memo was just a recap of the law. Before the final regulation is released, INS keeps us and lawyers playing the guessing game. Different views exist, ranging from the most positive one, held by Shela Murthy, to the most pessimistic one, which says "starting all over again". However, it\'s nothing but a guessing game.
If you have been laid-off before 180 days, please join this group. Our GC are not impossible, as long as the employer does not revoke one\'s I140. How to reply to RFE? Whether a new H-1 is necessary? Dealing with the sponsoring employer? These are all the tough matters that we are faced with. Let\'s share the info, help one another and start act together.
We will all pull through this ordeal.
