Anybody here whose name check took > 6 Months but < 1 Yr to clear

I was reading the congressional testimony of David M Hardy on Name Checks.

As per his testimony :

Approximately 85% of name checks are electronically returned as having "No Record" within 72 hours.

A secondary manual name search usually identifies an additional 10% of the requests as having a "No Record", for a 95% overall "No Record" response rate. This also happens fairly quickly.

The problem therefore seems to be with the remaining 5%

On this board, however, I seem to find only two kinds of people :

(1) People whose name check cleared easily - possibly within the 72 hours time frame or may be a few weeks.
(2) People who have waited for more than 1.5 Years for their name check to clear.

I was wondering if there are in fact people whose name check took a moderate amount of time...say 6 to 12 months.

Also, from the testimony it would appear that all of us who are stuck in the name check fall in the 5% category.

Considering the number of people who report of being stuck in name check on this board alone, I cannot believe that the percentage of such people is just "5%" overall.
I mean, I have to have some bad luck to become one of the 5 in 100 people who are stuck in name check.

Thoughts ?
 
No responses so far....looks like there is probably not too many people whose Name check took a moderate amount of time.

So my conclusion is that either your Name Check is cleared easily (few days to few weeks) OR you are in for the long haul (anywhere between 1 and half years TO Five Years).

Here, Name check waiting from 2004, what you are talking of >6<1yr?????

make a forum of pending name checks, you will get more and then do what you want to do

adding one more that Mr. David M Hardy says 85% but in reality there are lot people more than 40% waiting for more than a year. for testimony he will say nothing but in reality there are lot name checks pending and due to that many got stucked in retrogression.

he is also a govt emp and he will take side of his dept only and he knows, nobody will say why there are lot and get into detail whats going on in Name check dept.

As I understand that Congressional testimony in 2003,
98-99% of the security checks are cleared within 3 months.

Therefore, it's more like 1-2% they claimed but I doubt it
would be same percentage now in 2006. Another thing is
that these numbers are for a situation when there is
no or minimum backlog
as I understand. So as far as I
know, FBI is still standing by their congressional statement.

My source of information(local congressman) tells me, however,
there is a huge backlog in FBI's security check department.
Once when your case's turn comes, chances are you'll be
cleared pretty quick( which is meaning-less since they are hugely
backlogged.. :( )

So theoretically being pending in name check doesn't necessarily
mean you case fell in to this 1-5% chances of bad luck.
(Just one more added uncertainty in this whole GC mess).
My case stuck in about 9-10 months now.

I agree with what fdfd is saying. Some published numbers will turn up after you do some web search that a year ago FBI had about 180,000 names in backlog and currently FBI is primarily processing cases filed in 2003 and 2004. That seems consistent with what we are seeing here. Most of the approval posts from here are from cases filed in 2004 or earlier. Rarely do we see a case filed in 2005 that gets approved.

I think we are in deep mess if you ask me.

At least the USCIS has "Current Processing Date" for its different cases so you have a general idea when your case will come up for consideration.
With FBI's name check, there is nothing...just wait and pray to God that someday...some guy in the FBI will stumble on to your case....I mean this is worse than having to deal with the Babus in the Govt Offices in India.

It is "mental harassment" if you ask me - I mean how can you not provide at least a status update or an expected time frame for resolution. I am not asking that my case be resolved tomorrow...just want some idea about about how much time is gonna take. Unlike illegal immigrants from the South- most of us are not really "desperate" to live in this country and cannot wait forever for the paper work. If the FBI says that our name check process will take 5 years, many of us can make career and personal plans accordingly - like packing our bags and leaving. But keeping us in limbo like this should have human rights implications. I mean .....seriously !

In fact, there are quite a few 2005 cases which name checks were
cleared pretty quick. I do not have clue how FBI picks which one
goes first from the back-log. It appears that FBI also goes by
how old your PD is.

There's just no clarity in how FBI works (like other federal angencies).
Only information I've got is that the backlog in FBI is huge. They do
not know whether they actually started background checks on my case
or my case is waiting in the queue. Same conclusion we arrived
many times: We do not know how they work and they would not
let you know how they work....
 
Stuck in Name Check for 6.5 months. My 485 case is current. Sent inquiry email to FBI 3 weeks ago, still waiting for response.
 
FBI on their homepage have a link to the National Namecheck Program pages. There, in FAQs, it says contacting a congressman won't speed your name check processing. On the contrary, it says, will slow the general processing down, because you are tying up a resource to answer the congressional query. But is it that hard for them to understand that when things are not done on time, people endlessly waiting in line are going to need some sort of feedback and will initiate such queries anyway? So just like USCIS regularly publishes dates on various types of applications they are currently processing, FBI should start doing that too. That will reduce the congressional queries initiated by people like us. Now I am starting to think that dealing with USCIS is so easy. I mean, with USCIS I can take an appointment, talk to a real person and find out what's going on. The FBI seems like they are operating behind the iron curtain. I guess the "security concerns" bugaboo let's it get away with that!
 
I got following response on my enquiry of I485

Unfortunately, the principal applicant’s background security check has not yet cleared by the FBI as of this date. We regret to inform you that until the result is received the USCIS must suspend further processing on these cases. Thank you for your continued patience with this process.

it is very frustating reply from USCIS
Now what to do?? my application filed in 2004

Patience = virtue

All ye who rave and rant for lack of a Name Check completion by FBI, hear, hear.

I am 3 weeks short of 3 years in this loop:

do while (true)
ignore dl1cd's application
sleep 60
end do

USCIS will not shoot another query - because it sends my app to the bottom of the pile. USCIS tells me:

- Your case is delayed, please contact us in 6 months

I am sure 6 months later, my inquiry will elicit an identical response, or, who knows, may be:

- Your case is further delayed, please contact us in 12 months

All this while, officer Joe Schmo is vacationing in Waikiki and my case file is gathering electronic dust and the bits and bytes are losing their polarity as the image smudges ..

Why do I say this? Because I see people complaining that they don't have brand new shoes, while I have lost my legs (figuratively, of course).

Patience is a virtue. In this case, however, it is the only option. If you know better, please let me know.

(Yes, I have sent mails to FBI, Ombudsman, Congressman and my lawyer has sent faxes to FBI too).
