Hi there, my wife and I are divorcing but our I485 is still pending. My com filed for us. My lawyer said it\'s up to me if I want her case removed but the lawyer suggested me to remove. I don\'t see reason how green card for her can complicate our divorce. I\'m hesitating. Previously someone here wrote that if INS finds out later, her green card will be revoked. Can someone here see any complication if she gets green card and then divorces me? Your input is warmly appreciated.

Do you want her to have it ?

I can tell you this if she is reasonable and won\'t bother you with GC its upto you. But some people will apply for alimony if she is here and may take a chunk of your paycheck. If she does not have GC she has to go back and no problems to you.

So you take the decision. Reg INS if they dont find it out it is good for her and you know INS(how efficient).

3. My green card is pending through my husband\'s employer. We are now applicants for adjustment of status. Meanwhile, we are on the verge of getting separated. What happens to my green card which is based on my marriage, when the marriage is dissolved?

A: Unlike permanent residency based on a marriage-based petition, which yields a two year period of "conditional residency" following the I-485 approval; a derivative beneficiary of an I-140 petition becomes a permanent resident upon the I-485 approval. Thus, if your marriage lasts until your I-485 is approved, absent fraud or other extraordinary circumstances, your permanent residency should not be affected by divorce.
