Any suggestion before I get it rolling

I am all set to apply for my labour. I sent out all the documents to my company lawyer and they said it will get applied by end Jan,2004 thru my current employer (say A).

My 6-year term ends July,2005. In the meantime, I was thinking of applying LC thru another company ( say B) around May2004.

What do u guys think?

1) Can I change my employer from A to B around Jan, 2005 and still get my 7th year H1B extension thru company B?

2) Should I have any problem during I-140 or I-485 since the LC started before I joined the company B?

I will be talking to a lawyer, but some first hand experience as well as knowledge will help me better understand the situation.

Yes & Yes

No. Not solely based on reason mentioned in the question.


BTW, Why are you waiting till May to start LC from company B. Start that also right away.

Any idea as to what problems might be there? Have you heard of anybody getting into any type of problems later on during the I-140 or I-485 stage?

Yes Ray. Other ppl have also told me so, though I personally know a guy who went back to India after filing I-140 and 485. His company didn't back out from sponsoring and in Dec,2003 he got his GC.

On my part, I intend to join the sponsoring company somewhere in the middle of LC. My only concern is that the sponsoring company being too small, will INS create a problem?
