Given the new BCIS memo calrifying portability issue of concurrent filing, what are the reasons to choose non-concurrent filing, rather than concurrent filing?
I filed my I-140 (D-professional with advanced degree) in late July 03 with CSC for 2 benefits: 1. portability of concurrent filing was not clear; 2. CSC's I-140D only had 3 weeks between reciept and case assignment date, so concurrent filing's benefit may just be saving of a few weeks time.
Now, benefit #1 is gone with BCIS's memo as it states clearly concurrent filing enjoys portability too (right?), and #2 MAY not be valid today because all I-140 is being slowed down or on hold due to BCIS resources being diverted to religious worker petition till Sept. 30th (or Oct. in terms of impact).
So, please share any and all your reasons not to ask lawyer to start filing my I-485, before my I-140 is approved? I assume filing I-485 AFTER I-140 approval is possible and considered as concurrent filing?
