Updated 01/26/01: White House Orders to Seize Regulation Enactment Activities Pending Review by New Appointees

On January 20, 2001, the White House ordered to hold any regulations which have not taken effect as of January 20, 2001. It affects not only those that were at the early stage of proposal, but also those that have been published but have not taken effect. In the latter case, the effective dates of such regulation will be postponed for 60 days.
This decision affects a number of upcoming regulations which the immigrant community has been anxiously waiting. People know that the DOS and American Consulates have refused to issue K or V visas under the recently enacted LIFE Ace. The hundres of thounsands of spouses and children of U.S. citizens or lawful permanent residents who were qualified under the new law have been anxiously waiting for the regulations. Unfortunately, these spouses and children will have to suffer further delays!
RIR Conversion Regulation of DOL appears to be another victim. There are a huge number of people who have been waiting for this regulation coming into light ever since the DOL stated earlier that it would enact the regulation by December 2000.
The other regulation the immigrant community has been waiting is S.2045 legislation, particularly relating to change of job after 180 days of filing of EB-485. This regulation was scheduled to be finalized and implemented sometime in March 2001. It is expected that this schedule will also be affected somewhat.
Implementation of 245(i) with the deadline of 04/30/2001does not need new regulation and is not expected to be affected by this decision.
