any one from RD JAN 2002 still pending?

My case is from april 2002. I got approved on Dec 30. So i am well aware of what you are going through. Needless to say keep fighting and you will definitely get it. I think in my vase what might have helped was an expedite fax request to VSC have you tried this? Did you called up VSC and asked them whats going on with your case.
Also sometimes I have read from other posts , Name check could be a show stopper. Has your namecheck got cleared by FBI?
Please throw in more details about your case.

You should serious take up your case with VSC and tell them to expedite it. Its simply not acceptable to wait ....wait...and wait. You should also considering writing a letter to Ombudsman just like SUMANTA did and I am sure it will have a good effect. Good Luck to you and Hats of to you patience.

It looks like your name is stuck with FBI and I think you should write to Mr.Hooton about your case and also attach the letter you received from the senator's office as proof and tell them how much valuable time you are lossing because of this mess. Then based on the response from FBI you should then plan your next steps.
I had actually written a letter to Mr.Hardy and came to know that my name check was never received by FBI and then I did an expedite request to VSC and attached the FBI letter as proof and that made VSC to send my Name Check Request and everything went smooth from then onwards.

Was your I-140 approved for "consular processing" or AOS? Long time ago before the concurrent filing, some I-140 were approved for CP mistakenly by CIS and thus would delay the I-485. Check your I-140 approval notice and look at the fineprints. Did it mention it was sent to "National Visa Center"?

I sent AC21 and after that go an RFE on 485 for paystubs, tax etc. Sent them. I am relally worried if it s going to be a denial. Recently 2 weeks back contacted local congress man.

Usually there are various theories of LUD and I think one should not try to over analyse it as it just creates unnessary stress. As long as you have changes the job after 180 days and you have I140 approved too and also more importantly you have also sent the AC21 letter, I am sure you will not get denial.
Its quite possible that your employer might have revoked your I140, but you don't have to worrry about it as you are pretty safe and if you have responded to your RFE with all proper docs then I am sure you will get your approval soon!
If you know your EAC number for I140, then you can check the status on USCIS online or else you can ask your Lawyer to call VSC to check the status on it. Good Luck!

I am from Jan'02. Ac21 case. Had interview in Boston in Nov '03. Tried everything...nothing works....file now pending in Newark although I live in Massachusettes.Boston office requested Newark to transfer the file back in Dec'04 but it was in Newark when I checked with Boston office last month.
