Any News about 30 days approvals...

There is a news in immi-law telling who ever applies concurrently after April 30th will be revied immiediatly.

Except the following link, I did't see the same info anywhere else. Even My Attorny is not aware of this...Do any one have any idea about this pilot program ?

Yes. I did readit on immigration-law website.

They are implying that, if you file your I140 and I485 together in same package dated April30 or later, your applications will be reviewed with a seperate section of officers, to reduce the backlogs. And continues, ... similar processing criteria will be applied to existing I140 and I485 applications in "currently unknown" time.

my interpretations is that, they are doing a pilot program to see the amount of work they could reduce by this program. If they see positive results by end of 2006 USCIS want to bring the processing time of ALL applications withint 3 months.

Good thinking...but not helping existing applications...like me.

The information you are alluding to applies only to "pilot" program and not all concurrent adjudication. In the general concurrent adjudication cases other than the Pilot Program, both I-140 and I-485 are processed and adjudicated together and the processing times are instructed by the HQ to set at the I-140 processing times which is about a year or less in most Service Centers and not I-485 processing times. If this plan works, the I-140/I-485 may take one year or less. We will have to watch very closely.

The pilot program to be launched at CSC for EB cases and the same program to be launched at Dallas District Office for FB cases are targeting at adjudicating cases within 75 days or 90 days from the date of filing. In these cases, biometric proceeding and security clearance are triggered immediately upon receiving in the EB cases and interview is conducted at the time of filing in the FB cases. Under the plan, some cases may be approved even prior to complete security or crime clearnce but once the problem is detected, they plan to revoke (cancel) the approval. The pilot program is indeed excessively agreesive under the present environment.

However, both the Pilot program and the general concurrent adjudication program are launched on the same logical premises, to wit, that preventing further backlogs from the frontends could general contribute to the gradual reducation of the current backlog. We'll see how it works.
 
Can you refile ?

Yes you can. Let's wait and see how accurate all this information is and we'll take action then.
 
Assuning you can reapply ...

1. It is expensive to get new medical reports ($250 per each I485)
2. Additional INS fee
3. Additional Attorney fee
4. Indicate in you I485 that you have already filed one. You cannot lie that you did not file another I485.

Not sure whether it is appropriate. And most importantly, most of the attorneys does not have confirmed info on this. So, we can't be aggressive in this matter.

Fees are not the issue

I doubt the fees are issues to anyone. If it guarantess you a GC in 90 days, I am ready to go through the trouble again.

The real issue is whether we trust it will be done in time or not. So you don't end up removing an older case and wait longer for a newer one.

I know tons and tons of questions and ideas will be shared shortly after all this is clear.. for now all we can do is wait and HOPE !!

Totally agree with you. I got my LC approved week ago, but now, I am deciding to hold my 140/485 application until after 4/29/04. I think it is worth to wait that much time and to battle for the cost of price increase from our company:-))

We can revoke our App'..But ...

I checked with INS people and they told me that we can revoke our appliction, but out Attorny should give them good explanation of why we are doing this....She also told me it may affect our case..but she is not sure....

Actually asked the same in for on immi-law to her and she asked me to show the same info on CIS or any govt' website. As u all know we can't see the same info anywhere else...

When I check with my attorny, she asked me the same that it not there anywhere ...but she told me that we can revoke the application, but its going to cost more than $1000 ..which is not a big deel...

Today's latest news is the Pilot program is implemented in TSC from today but it is not for Employment based people...

No one knows when this program is going to be implemented for US...

FYI...I sent my Concurrent Application last Thursday to TSC and on Friday the above news came...We may get some info in comming days..

-- Not a big deal. Who cares about paying another $250 (just several fine dinners) to get the GC within 90 days rather than waiting painfully and desperately for years???

-- I am willing to pay from my pocket if they allow me to refile!!!
 
I have filed my I-140 with CP option, now if I want to convert to AOS (485) after 30 APR, would I get the benefit of this faster processing? Any idea? please put your thoughts.
