Any more news about change in AC21?

Is there any more news regarding altering the AC21 memo so that you can change job before I140 approval?
We really need to use it desperately. Hopefully, they come out with something soon.
 
I used it.

I used it and got approval of i-140 with no rfe. I informed bcis about change of employeer using AC21
 
This is inline with what my lawyer said today. According to my lawyer ( very much involved in AILA) I could change the job / work on EAD after I-485 pending regardsless of I-140 status.

Anyhow, my best advise is check with your lawyers.

This is info would help some people who had questions in this topic in several forums. When I talked to my lawyer, he said the same thing which now your case confirms it clearly.

BTW, what is involved on AC 21. Does your new company has to send anything ( ie new I - 140 application) or you sent just letter stating your change in employment. It would be helpful if give some details.

-- what's involved in filing AC21? Is it just a letter from your new employer stating your title, salary, responsibility, etc? Does the new company have to disclose any financial information.

3.Can we file AC21 as a response to RFE about 'Ability to pay'?

First time I heard of someone got 140 approved after using AC21. My company is closing down and the lawyer stated I'm not eligible to use AC21 because 140 is not approved. Can you give us more details about your case? Those asked by other people are good enough.

Answers on AC21/I-140.

-- did your previous employer withdraw your I140?
No. they didnt, You have to make sure they dont do this, becuz it could trigger intend to deny.

--after you filed AC21, was the I140 approval sent to your new or previos employer?
It was sent to lawyer.

-- how soon did you file AC21 after leaving the previous employer?
Immediatly, with employmenet verification letter stating my job title, salary and responsibilities.

-- what's involved in filing AC21? Is it just a letter from your new employer stating your title, salary, responsibility, etc? Does the new company have to disclose any financial information
My lawyer sent letter to INS stating only thats my client is using AC21 and attached the letter employement verification letter. No new compnay didnt have to do anything.

I am not sure about your question, but new employeer didnt do anything. They didnt have to.

No. I was the first employee which they sponsored.

To summrize this, I think you can change the job after 180 days of I140 and its better to inform ins about this. AC21 states about 180 days of pending I-485.

I would have gotten my I-485 approved also at the same time but becuz of doctor, which didnt specify about vaccination history, I got RFE.

Will changing a job to a different location (new company) that falls under different service center cause any complications? (Pardon me if I'm changing the line of duscussion in this thread. I thought this is relevant.)
