Any issues in travel using AP when too close to approval

We have the H1/H4 Expired.
I-94 Expired.
Currently working on EAD.
Any Anticipated complications on Travelling on AP.

(Too Close to Approval)
Rd : 5th Nov,2001
ND : 6th Dec,2001
AD : ????????????????????????


What happens if any one receives approval while on AP and out of country ?
 
I dont know much abt it. Only I can say is avoid journey unless it is very important. Otherwise u have to pay all the time invested for ur GC. But , u can travel .. try to come before ur case is approved otherwise they may deny..

Anyway consult ur lawyer they are best the people to guide on this

Don’t worry…

You will be all right as long as you have valid AP for re-entry to US. I am traveling on 11th to India. My case was under review. I asked the same question my attorney. The answer was there are no problems traveling with AP under these conditions. I hope this is clear. If not, please let me know your specific question.

Here is the specific question.

What happens whn Primary and Derivative both are in India and If the GC is approved.

what are the concerns for primary to travel while on AP/EAD and All the Visa's are expired with changed jobs.

what are the concerns for derivative to travel while on AP/EAD and All the Visa's are expired.

Is it advisable in current climate.

How do they treat at varios transit points in case of expired Visas.

I would not worry

AP allows you to re-enter after travelling out of the country. This is the only reason you have AP. As long the paper work is clear I would not worry about it. Just enjoy your trip.

Just do a search in this forum and murthy.com. You will find that when INS approves your 485 at POE you will be sent to secondary inspection and after verifying the documents they will parole you inside the country. Once you are inside you can go for stamping.

Nothing unusual! When you get back to US, you can get GC stamp on your passport as any regular I-485 approval.

As per my knowledge you must have a valid AP or valid H1 stamp on your passport to re-enter into US. Job change may trigger a RFE but it will not affect your travel.

As per my knowledge, there will not be any problem for derivative if they have valid AP.

It is not advisable under current INS conditions. But you can travel as long as you have a valid AP or a H1 stamped passport.

I don’t have any idea about transit points. I am sorry for it. You can search this forum by that key word. I believe there will not be any problem because we will not go out of airport.

I thought that AP (and maybe even I-485) is deemed "abandoned" if you leave the U.S. before approval of your AP...

Ask a lawyer.
