I Seem To Be In A Fix Here

I Have To File To Adjust My Status But There Seen To One Thing That Worries Me .my Usc Wife Has A Criminal Case Pending In Court Against Her.

What I Like To Know Is That Will This Affect My Case In Any Way If So How And What Will Be The Best Thing To Do In This Case.

If Not Then Just Leave Me A Good Will Message Or Any Other Advice Or Tips You Have.

Your wife’s criminal case could have a bearing on your AOS interview. She will have to be present at the DO for your Interview.

Your wifes criminal case could be a problem at the interview, as PS182 mentioned she has to be present at the interview.

I would seek an attorneys legal council on this matter.

You mentioend a "pending " criminal case, is there anyway she can get to court before the AOS interview and sort things out? If it is something she can take care of early that would be best! Hopefully she can plea any charges down to avoid jail time.That way you can take court affidavit of the case to the interview, showing good faith in resolving this case. If it is something that will land your spouse in Jail, :eek: You will need an attorney & then it will definatly effect your case as your USC spouse is your sponsor and if Filed I-864ez she is responsible for you financially, she can't very well provide support if she in in Jail!

One thing to bear in mind during the interview.
DO NOT VOLUNTEER any Information. only respond to questions asked, with short answers and give only what is asked or neccesary! You may be able to slip through without that coming up.

However I would be aware that the USCIS has all of your Spouses information ( G325-A)
and can do an FBI check on USC as well, I am not sure if it is part of the regular protocal , but USCIS may do Random FBI checks on USC spouses Sponoring Immigrants.

Does anyone here know if the USCIS does FBI checks on the USC petitioning for immigrant spouse?

So anyonehere! What were your experiences or what info if any do you have to add to this thread?
1)Was your spouse denied AOS approval due to the USC having criminal record or other unreseolved legal issues?
2)How that came to the attention of the USCIS.?
3) How was the problem resolved, did the USC have to provide any additional info such as court abstracts?
