Any idea what's going on with NSC?

Folks,

NSC seems to be slower than ever.
Any idea what might be going on? Any documents out there explaining what they are doing? Why have they almost stopped processing?
 
yo know what marc..I have resigned

myself to the fact that I will not see any movement in my case this year (damn - I was so damn close) ..and I also realized that with NSC the default is :
No case assignment (or most IIOs are prob on vacation)
then ,somedays,if they feel like it - why not let an immigrant or two in...so...that's it for me..
As for layoffs,it's a very near reality for me...
all signs from above that staying in the US was not for me..some guy across the street can come and drive a cab here..no probs..but not for me...
oh well..C'est la vie,eh mon ami??

Frustrating and very true

Hi Jack and Marc! Hope you guys are keeping ur cool!

It is unfortunate or highly irresponsible for INS to be doing this. They have to change their attitude and it has to change from the White house. They have to realize the contribution of all the new and imported skills that have made this Country - Greater. True! it is a daunting task to identify and filter the Terror weeds off. But that is no reason to maintain this communication gap and a rediculous customer service.

The Approval Process has to be made tranparent , the Application status has to be much more precise and time frame , predictable.

I am prepared to understand the delay - only if I am treated with respect. So far .. I have not felt any respect!

It is the same story ... again and again and again !!

Hold on guys! till u are out of this loop.
 
Really slowing down

My RD is OCT29, Spoke to an IIO this week, they told me that they are processing June cases now, with that my case may take 4-5 months....

Thats a long long wait..:(
 
Develops Character

Guys,

Consider this as a character building exercise. NSC is teaching us patience, perseverance, hard work, emotion control, and teaching us to not get too excited (bad for heart), and many more i don't know. So they are actually doing us a fovor.

The more the delay, bigger the favor.

This is ridiculous.

who is a member of AILA. they probably can shed some light. why suddenly everything came to a halt. one approval per day . if that is before holiday what will happen after thanksgiving :(

INS closed on Monday

Monday is the Veteran's day. As a result, this is a long weekend for INS. Hopefully we see some approvals next week or 2.

rupnet might be just small percentage but

so far it was pretty consistent in showing 3/4 approvals per day which i guess was an indication that something was moving somewhere.
 
what happens to all of us now...

so many people's FPs will be expiring soon,including mine in May 2003...what happens to all of us..as NSC doesnt seem to be processing at all..Is there something - anything we can do...
And I am SURE NSC will not approve any more cases this year...so maybe someone will look at my case in MArch 2003... if I am not laid off by then..
Gosh..cant begin to imagine why they are doing this...I mean if INS is anti immigration,why only NSC..why not VSC or CSC

For you guys looking for some reliable information, here's what our prominent AILA member attorney sent me:

The official processing times report tends to be somewhat behind the actual processing times. Currently, they are behind because of the internal audit in October and IBIS check. The IBIS check delays the process tremendously.
It is not likely that the result of the election will produce any favorable immigration policies, no matter who takes the leadership role in the Congressional committees. Besides, the immigration business is destined to come under the new DHS and no one knows how it will affect the efficiency and effectiveness of government work. This election reflects a strong anti-immigration mood in the country regardless of the fight on terrorism. The current development gives a sad feeling. As for NSC, our record reflects that they are currently approving ND of October 2001. Last week, NSC told us that EB-485 takes from 13 months to 15 months. I will keep my fingers crossed.

Also T-Rex: Anti -immigration - here's my take:
Some SCs are still proceeding really fast...so that shd not be a problem..
Also anti-immigration seems to be affecting EB based ,and not FB based,which I feel is USA's real problem - not Mr. XYZ in Company ABC contributing in every possible way to the US way of life.
As for anti-H1B - it's BS..as the real crooks are the corporate big wigs,and even if there were no H1bs,there wd still be layoffs..I mean which companies are hiring H1bs and laying off citizens..thats BS...IT's nearly impossible to get a company to justify an H1b sponsor at this time...
and if NSC has taken it upon itself to implement the anti-immigration stance all by itself..screw them..I Dont want to stay here..
I am trying to figure out a way to xfer my case to CSC.

Can someone explain what IBIS security check is? Do anyone know why this check would slow down the AOS processing. Thanks in advance.
 
IBIS security check

"INS has instituted a new process whereby all petitions and applications are being subjected to a new security check. These new checks are apparently being required even for those cases in which a good deal of processing has already taken place.

While the new security check mandate is in effect at all INS offices nationwide, implementation of the new process has been uneven at best, as some INS offices reportedly have limited access to the Interagency Border Inspection System (IBIS) database against which the checks are performed, and even where IBIS is available, many INS officers have yet to receive training on the system.

As a result, we are expecting longer processing times and changes in INS District Office hours. "

IBIS Procedure (from www.murthy.com)

INS performs background checks using the "IBIS" database for all types of applications and petitions, whether filed at the regional Service Centers or the local District Offices. These checks occur within 15 days of receiving the case and remain valid for 35 days. If the adjudication occurs more than 35 days after the IBIS check, a new check is required.

These timeframes can become an issue for Adjustment of Status (I-485) applications. In those cases, the Service Center sends an approval notice directing the applicant to the Local District Office for a passport stamp. If the passport stamp is done within 35 days of the last IBIS check, no additional check is needed. If a further IBIS check is needed before the passport can be stamped, it may take only a day at many of the local offices. However, if the check results in a "hit" (a match with a record on file of a person with a criminal issue or other serious problem) the case may take much longer to resolve.

Note that, since IBIS is a name check system, if one has a very common name there may be a "hit" based on the record of some other person who happens to have the same name. In the event of a hit, the local office is required to place a stamp in the passport as evidence of permanent resident status, valid for 30 days only. This stamp will provide evidence of authorization to work and will allow travel for the 30-day period. No mention was made regarding procedures if the matter is not cleared up within 30 days but, presumably, the person could obtain another stamp if needed.

WHAT HAPPENS IF IT IS PAST 180 DAYS OF FILING 485 AND YOU GIVE NOTICE THAT YOU WILL QUIT THE JOB TO THE EMPLOYER. THE NOTICE PERIOD LET'S SAY IS 6 MONTHS. NOW, IF DURING THIS NOTICE PERIOD, YOU ARE EITHER LOOKING FOR A JOB OR IN TRANSITION TO ANOTHER JOB AND YOU ARE STILL WITH CURRENT EMPLOYER, I HAVE 2 QUESTIONS IN THIS SCENARIO:
1.WHAT IF THE EMPLOYER INFORMS INS THAT I AM LEAVING THE JOB
2.WHAT IF INS ASKS FOR LETTER FROM CURRENT EMPLOYER-THE CURRENT EMPLOYER MAY NOT GIVE THE LETTER BECAUSE HE HAS BEEN SERVED NOTICE OF RESIGNATION AND THE FUTURE EMPLOYER MAY NOT GIVE BECAUSE I HAVE NOT STARTED WORKING YET! MY GUESS IS THAT THE LATTER IF AGREES TO GIVE THE LETTER SAYING HE IS GOING TO BE EMPLOYING ME IN THE SAME OR SIMILAR PROFESSION, GETTING SAME OR SIMILAR SALARY AND WITH SAME OR SIMILAR JOB DESCRIPTION, IT SHOULD SERVE THE PURPOSE FOR INS. PLEASE COMMENT
