Guys,
I have asked this question before but since my company is trying to take me for a ride (I think), I need your help. My company\'s legal deptt says they are ready to file a I -140( A new I -140 as they say), they say they would do all to indicate that it is for an existing I -485 like attaching a note and copy of my I -485 receipt on the outside of FEDEX packet as well as attach documentation with the I-140 application.
But they say most probably the mailroom at INS will not recognise this all and put it in the normal I -140 queue which is 10 months. They say unless they receive any notification against my I - 485 which they have not it will always be a refile and not a redo I-140. They say I have an approved I -140 but in the previous company name and hence they cannot amend it !!

Help please !!

Hi,

As per the info I have (I may be wrong on this) under normal circumstances
I do not think there is a way to expedite a 140 unless its sent in response to an rfe.
An amended 140 is generally treated like a regular 140 unless as stated above its sent in response to an rfe so generally the standard processing time applies.

This company name change hold is very frustrating

Your company can, while providing all the info & fees for a new I-140, also provide a copy of the corporate/merger/acquisition/name change documents too along-with a copy of your previous/original I-140 approval. Chances are, it will be considered as an amended I-140. Once your company gets a receipt from the INS, get a copy of the same, and contact your Congressman/Senator and tell them the situation. Tehy will be able to call up the INS and make sure that it is treated as an amended I-140 and not a "regular" I-140....

If your company files as a \'batch\', all of the i-140\'s will be approved pretty soon, which is what happened to my case. I think there IS a column to differentiate redo or new 140\'s, but am not for sure.

Good luck!
