Any I-485 approvals with expired FP

Hi,

My particulars are as follows
I-485 RD 02/19/2002
ND 03/11/2002
FP 06/20/2002

RFE for employment verification on 10/27/2003
RFE response received by BCIS on 11/21/2003.

I (spouse and I) did not receive any 2nd FP request.

I have been noting that almost all the Feb 2002 ( or other) RD approvals here and in rupnet either got 2nd FP requests with their RFE's or have unexpired first set of FP.

Is it correct to assume that the lack of new set of fingerprints is what is holding back my case approval ( I realize that BCIS might not always work in the most rational manner - but I am trying to look for plausible reasons why my case is not yet approved).

Also, for those who received requests for 2nd FP. Did it always accompany the RFE or did the FP request come in later?

I am concerned that my file might be collecting dust on the IIO's desk for a while before FP instructions are issued.

Any thoughts would be appreciated.

You may contact a Senator or Congressman to get the 2nd FP notice. It is better you go personally to the Senator's office and talk to them, so that they could take up your case with BCIS.

Since you have got RFE, your case me be very close to approval. I have seen only one posting here with expired FP approval.
 
I got 2nd FP but no RFE. I think you are close but I am not.

I got my second FP notice a few days after I got my RFE. In the meantime, I had sent my AR-11. That might have triggered the second FP. Otherwise, my case is similar to yours. Hopefully, we will get our approvals soon.

Yes, you are correct in assuming that approval without a valid FP is not likely. If somebody does has such discretion at the INS, it is too high up to help ordinary cases. You should shortly be receiving a second fingerprinting notice.

FPs and RFEs are handled separately. I am not aware of any FP that was clubbed together with an RFE by the INS. They may conincidentally arrive in your mail box on the same day, but they come from different parts of the INS labyrinth.

Your file may or may not be collecting dust, but the one aspect that should comfort you is that INS does not seem to have earnestly begun to process Feb./Mar. cases. There were a couple of approvals, but I would think that they are currently still working on Jan./Feb timeframe. Remember, the lottery, by definition, cannot be won by more than a few in any single drawing.:)

ThaNKS A lot guys for your opinions.

I guess I will wait out the rest of the year waiting for 2nd FP instructions. If I do not receive them in the next couple of weeks I will get in touch with a congressman / senator and request them to ask BCIS to send me 2nd FP instructions.
