Thank you for the info. and hope your 485 gets approved soon.Could you please tell me if you had to talk to IIO about 140 redo, to make sure it\'s not lined up in regular 140 waiting list.

Some how I have this impression redo\'s are lined up separately, correct me if I am wrong.

I did call the IIO to make sure that 485 and i-140 are linked. But she told me that it was already linked. In fact my 485 message also changed to RFE recd a couple of days before my I-140 was approved. Surprisingly the I-140 message did not change after I-140 was approved. Hoping that 485 will get approved soon.

Tata - I think it\'s a good idea to call and talk to INS making sure it is not being treated as a regular I140, since it\'s a redo I believe
it has has to have some priority.

Last time when I called I asked IIO if my case being lined up along with regular cases or in a separete pool.I explained my case details
like 485 ND etc, and asked if my I140 redo has any priority. The reply after a minute or so waiting was my case being treated as regular and she is going to send it to proper \'department\'.

Bye the way, my I140 redo has A# on it.

Hope this helps....

I think U have applied for I-140 redo in anticipation of a RFE in Sept. The I-140 redo will be expidited only if u attach the copy of the RFE which in ur case u did not have since u did not get a RFE at the time u applied for Redo. Probably ur I-140 is considered as a fresh i-140 which is the reason for the delay in approval.

Hi Guys,
Thanks for the info.
We applied for the 140 amendment in anticipation of the RFE in Sept\'2000.But when we received the RFE in November,it was only for the employment letter. (By the way, all my colleagues who hasn\'t applied for 140 amendment received RFE for 140 redo). When the lawyer sent back the RFE to INS,he attached a copy of the 140 amend.receipt notice along with the employment letter.Last week I called up INS and the officer told me that 140 REDO and 485 are linked and it\'s going to take 3 weeks to hear anything from them.
Still waiting and hoping for the best.

Update on my I-140 redo, glad to share info about my 140-redo approval on 02/13/01.

I spoke to an IIO who has told that my I140 has been approved Today!.
Asked IIO if she can look into my 485, she verified and said they are waiting for some info since Nov14,2000.At that point I told her my I140-redo is infact a response to that query. After that I was told my 485 processing officer will be notified of I-140 redo approval, and indicated to call after a week or two.

I know for sure lot of fellow applicants are in similar situation as I am and again reueqst you guys to please share info.

Just saw this posting. Does this affect we, I-140 approved people waiting for 485 approval. I am concerned that a lot of us are waiting with I-140 redo approved but nothing on the 485. Also not seen any 485 approvals after I-140 redo. I-140 redo waiters any comments on this.

I-140 approved Jan 17th waiting for 485. No news at all. Almost a month.

Pardon me but what is this portability thing?.We were asked for a I140 redo, we still are working with the same company(name chaned/been aquired)so I don\'t quite understand how President\'s review going to effect our 485 processing.

Could some one like Kiran Hegde2/Govinda Vinod or some other knowledgeable persons answer this, please?

It means that the President wants to review all legislations that were passed/approved by former president Bill Clinton that have not been implemented yet. Of course, since DOJ and/or INS have not come out with regulations on S2045, it is possible that the there could be some delay in implementing the same. Personally, I don\'t see a big chance of the (new) President wanting to change the legislation from the way it is. But it definitely might delay the implementation of the rules.
That said, it affects only those who are trying to use the new rules, for example, to switch employers before their I-485s are approved etc. For those of us still working for the same employer and going through RFEs for emplyment verification letters and pay-stubs and G-325s and the like, it will not make any difference as the new legislations do not come into play. Hope this answers your question/concern....
