I recently haven’t seen any I-140 denied because of company’s ability pay. A couple of week ago Murthy newsletter wrote something that USCIS would soon scrape this requirement.
Has anyone got I-140 denied because of company’s ability to pay, please share your experience/what went wrong/what we should do to avoid denial/etc

Submitted: year 2003 tax document, notarized company’s financial statement, my 2003/04 W2 and all 2004 pay-stubs
Very small company
Revenue 350K-400K
Company’s Profit < my LC salary
2002 W2 $5K less than LC Salary
2003 W2 $9.5K less than LC Salary
2004 Pay-stubs salary = LC salary
