Looking at the april visa bulletin can somebody give me guidance as to if getting a substituted labor certification a better idea than waiting or switch jobs using AC21.
The labor is filed in my name while both me and wife are presently working in 2nd EAD.
My situation is as follows:
Category EB3 India
Filed Labor Certifcation Oct 2002
140 Approved oct 2004
485 Filed Since oct 2004
1st FP done on Feb 2005
Curently in 2nd EAD
If labor subsititution is a better idea then can I file for new 140 since I am in EAD and my six years of H1 is over or can my wife file for it.However her H1 expries this year in April/May.
Please Advice
