And your friend applied for 485 at about the same time as you ? (as in around May 2004 ?)

Since you say your friend's PD is after yours, I assume that your friend was either an EB2 or not from one of the retrogressed countries ... would that be correct ?

Hi Jambalakadi & all,

It looks interesting. My PD is august 2002 and substitution case(EB3). The satus never changed from Day 1. Mine is 140 & 485 concurrent filing. 140 approved in august 2003. RD is aprial 24 and ND is May 1st 2003. Will have to apply for 3rd EAD renewal. Thinking of changing company...with the same job title and salary more that what I am getting. Do you guy sees any issues?

Cool .... so let me get this straight ...
he is EB3 from India and his PD is after Aug 2002 sometime and his 485 ND is around May 2004@NSC and he got APPROVED ?!?

One lucky guy to have beaten the PDs and JIT dates -- ask him whether I can borrow some of the secret luck sauce ;)

Not necessary.

I've heard of some cases where, for example, RFE was issued before the PD retrogression.
RFE reply was sent well after PD retrogressed and the 485 was approved even though PD was not current.
I think its more like if your case is "picked up" by an officer before this PD thing started, it will be completed or something like that ?!

But, yeah would be good to hear back from gcnsc regarding this .... maybe the PD was incorrect - who knows ?!
 
I am not bluffing and it is true. He is my colleague and we both work for the same company. His PD Oct 2002 and I-485 ND/RD is May 2004 and Approved Date is around 5 th APR.

Filed non-concurrently. It's all luck. And it depends on the Adjudicator.
