Any EB2 485 approvals??

I haven't seen any Eb2 485 approvals recently.

It seems to me that USCIS is processing 485s in the order of Priority Dates rather than RDs.

This seems to explain why EB2 485s with PDs in 2002 are not being approved. It is confusing because on the USCIS website, the current date for 485s is based on RD (Mar 2003) even though they have approved quite a few 485s with RD in 2004.

It is so frustating!!

If USCIS process the applications as per PD then I am very happy, but unfortunately they do not. My understanding is they process as per RD if PD is current.

Your confusion may be reduced to some extent by going through I-485 Standard Operating Procedure or by reading the Rajiv's plaintiffs litigation against USCIS filed last year.
In a nutshell it all depends on two things 1. REF ( I-140 and or I-485)
2. how fast USCIS gets the FBI name check and some other checks.
That is how USCIS explain that every case is staged according to 1. Ref / regular cases 2. PD current / not current 3. Category 4. Other clearances.
Once evrything is clear then that case gets cleared earlier compared to Ref cases. Therefore my understanding is USCIS is now working really hard to expedite the process.
