Any 'connection' between Visa Bulletin Date and processing date??

All,

come January and we face one more obstacle in approving 485. My question is how to read publish date and its relation with PD with the perspective of EB3?


Assume my PD is DEC 2001 , ND JAN 2004

Scenario 1
Assume we are in January 2005

-USCIS Publish date shows Oct 2003 and VISA bulletin date is 1 JAN 2002
Q> I am eligible for 485 approval bcuz my PD < 1JAN2002. But would USCIS pick my file for processing ? or do I have to wait till publish date becomes 'current'

Scenario 2
Assume we are in February 2005 now.
Because of heavy demand for Eb3, date further retrogressed to, lets say. NOV 2001.
-USCIS Publish date shows JAN 2004 and VISA bulletin date is 1 NOV 2001
Q> Would USCIS pick my files for processing because 'last' month I was eligible ?? or I would wait for PD to become current now????

I think u r really screwed. U should withdraw ur application to get out of this confusion

PD is priority date not publish date. If your priority date is before the visa bulletin cutoff date of Jan, 1, 2002 you are fine and they will process your application. If the visa bulletin date retrogresses further and it is before your priority date you would have to wait until the priority date becomes current. It has nothing to do with what your center has published as the date it is now working on.

I think it has to be. VISA bulletin publishes PD date for 'filing' I-485. If I interpret your statement, cases with PD < 1JAN 2002 and ND Dec 2004 (this month) will get I-485 approved/touched next month . If this happened then WOAHHH...
