Any chances that CSC would approve Feb I-140s by Dec?

Hi Folks,

I need your help in making a decision. I am on H1 and my assignment gets over in Dec end. Since my company has a zero bench policy, it would send me to India as soon as the assignment is over. And my stupid company is incapable of finding new assignments in the year end.

EB3
I-140 (CSC) - ND - Feb-02-2004 (Labor subst.)
I-485(VSC) - ND - Mar-18-2004
FP Scheduled - Nov-20-2004

What are the chances that my I-140 would be approved by Dec? Basically want to use AC-21.

The other side to it is my wife is due for March 1st week and its inadvisable for her to travel after Dec 31st. Which means I wd have to take some decision ASAP.

Any suggestions you guys have would be highly appreciated.

If you look at the processing dates,CSC is processing I-140's as of 16 Jan 04

So I would say that you have a good chance of having your I-140 processed by Dec 04.

Couple of things that concern me are -
1. Vacations that USCIS people wd take in Nov-Jan. This would be significant if I get a RFE.
2. Though the dates show Jan 16, I haven't seen too many approvals on this forum for I-140s filed in 2004.
 
You betcha....Ive seen cases from 2002 still not approved...
My case is another example, EB2 140/485 conc 01/21/2004..no news yet

So you never know...if you lucky, you'll get the whole thin in the next few days...
So the question is How lucky do you feel?
 
If your company is willing to continue your GC, maybe you can withdraw your I-485 and request for consular processing on your I-140. I think this is a last option plan..
