Any Advice...rejected I 485

Heres my situation, my father was granted asylum in 91 including all his immediate family. I was a minor at the time. In the meantime my family applied for PR without me when I was over 21. It was stupid due to famly squabbles I wasnt on speaking terms and didnt listen to my fathers pleas to get my fingerprints and picture, so they applied without me. (stupid I know). We have been in the US since 1978, I was only 5 when we came here. I went ahead and applied for PR in july of 1999.

In Nov 1999 my application was given a priority date and it was recieved, unfortunately due to a bank policy the check for the fee was declined by my bank!! Any way I recieved notive to send a money order or cashiers check or my case would be dismissed. I sent a Money Order back to Nebraska with the notice and it was sent back that they dont accept fees without an application??? I went to the local INS office in San Francisco and after an immigration officer looked into it he told me to go ahead and send the money order back to N.S.C. The Money order was dated on 2/14/200. On March 31st I recieved notice that my case was dissmissed due to not paying the fee.

After many phone calls to the INS collection dept in Burlington Vermont, I spoke to an ifficer who recieved the Money order and supposedly sent a "CC Mail" to Nebraska saying the fee was received. I made a few more inquiries and was told that the processig times was running about 3 years and my case was in process.

When the processing priority dates passed and still no word I made another inquiry and recieved notice my case was still in process. When I called again after 3 months they investigated and told me that infact the fe was never received and the case was dismissed in 2000!

I went to my bank who provided me a copy of the Money order showing it was dated 2/14/2000 but wasnt cashed until 4/07/2000, when I called back I was told that my only option was to start all over again ad re-apply to get a new priority date! After 6 years all they could say was sorry start over!

Anyone have any Ideas for what I could do to request my original priority date? Do I just suck it up and start over?

I would recommend you write a letter to CIS and CC your senator. If you can visit your senator and explain this to him/her it would be even better. It sounds like your case fell through the cracks and I'm sure if you get the right person they will try to help you. Good luck.

The best Idea is just start it over. Assemble new application with the proper fee and send it. They will definitely see your situation and you may get approved within months. Also, explain your situation in separate paper.

Take responsibility of your actions. Also, ask your bank to refund you your money since USCIS didn't do their job........Be smart and try to move...File new application...
 
Did uscis cash the money order?
If I were you, I would re-apply, attach an explanation letter with details and date, send certified mail. When you receive a receipt, write a detailed letter to the senator and explain your position. Please try to refrain from describing details regarding squabbles with you family
