Any activation required switching over to EAD?

Right now I have both valid H1 & EAD. My H1 getting expired by Nov’2004. But I have valid EAD till June 2005. I wish to continue working on EAD. To do the same should I need to inform INS?

Please let me know what is the procedure to follow?

Note: I am continue to work for same old employer. Not changing Job / employer.
 
You don't need to inform INS but you need to update your employer with your EAD by filling up I-9 Form.

Just now I noticed that, my H1 was expired on Oct 4th 2004, but I have I-94 till Nov 4th, 2004. Since I am overlooked H1 expirdity date, I have not informed to INS with form I-9. I have valid EAD from the last 18 months.

How INS interpretate my case. Since I have not filed I-9 form before expired of H1, are they considering my case as OUT OF STATUS for that short period?

I-9 will not be sent to CIS, it's an employer's responsibility to file it with your latest employment eligibility.

As your H1 is expired, you'll be working on EAD from the date of H1 expiry, and you are in status. Just send a copy of your EAD to your employer.
