Any AC21 Approvals?

Hi all,
I applied for I-485 more than year ago and was laid off recently(> 180 days). I talked to my lawyer and they say i need to file for AC21. They also said since there are no clear regulations on AC21, all the AC21 applications are held without approval.

I wanted to find out if there is anyone out there who used AC21 and got approved.

Any responses will be apreciated.
 
That is not true as I know some of AC21 case got approved even without RFE. (from NSC)

also check rupnet July case user neni got a RFE after AC21.

I myself have changed employer after 180 days and waiting to see what happens (yes informed INS).

After you change the employer did you inform to INS?

Did you inform on your own? OR through Attorney? After you change the employer , are you still continuing with old employer's attroney or you chaged the lawyer?
Please let me know , because i may need to change my current employer after 180 days like you. So i have to prepare for all these things.

yes I informed INS (thru my attorney). I didn't use service of my old employer's attorney. hired my own attorney with company's approval and continuing with him.

my present company send him the employment letter for 485 portability etc. he sent those to INS . Im just got the fed-ex receipt (don't even know what he sent)
 
change in service center?

What if the new job is in the jusrisdiction of a different service center other thatn NSC?
do we stay with NSC or swtich centers?

Hi all,
Does anybody know how much time you have after you are laid off and are on an EAD before INS comes knocking at your door. Also if i get a new job does it have to be based on the same technology i.e VB if the labor cert app says VB ?? Does it have to be in the same city that you are current company is at and stuff like that

Do you think AC21 with a significantly higher salary on new job will cause a problem?

It worries me that the murthy.com site said significant difference in salary would cause the INS to suspect that the jobs may not be same or similar.

Regarding your status, as long as INS has not adjudicated your case, you are a pending applicant and you should be fine. Technically, your current employment has nothing to do with your GC application since the GC is supposed to be for future emloyment. The problem is that if your sponsor lays you off, then it is hard to make a convincing case to the INS that they are going to hire you after your approval. Of course you can try to use AC21 and move to somebody else. The most important criteria according to general consensus is that the job description should be similar enough to the one quoted in your labor/140. As to salary. location etc there is no explicit mention in the bill that they should satisfy any specific criteria. If all this sounds vague and confusing you are not alone. This whole approval process is a joke!!! So keep calm, have a few laughs at its absurdity and hang in there!!!
 
Change of Employer

I changed employer after > 180 days and called attorney if I should inform INS. She said no need and now I talked to her again and she said we should have informed them but says she will take care if any query comes. Hope I don't get screwed becz of my Attorney's swinging mind....

Does anyone know a case where applicant didn't inform INS and had to submit prrof of Employment??
 
I am wondering about the same question. But I changed job in August and haven't informed the INS (although in AR-11 I did enter the new company name).

I am planning to inform the NSC in December.

Really want to know if there is any one out there who was harrassed by the INS just because didn't inform INS untill RFE?

Godlove: do you know why your lawyer changed her mind about that?

I don't know what happenend to her !! but she still insists that it will definitely not be a problem.

I will suggest you to take caution when informing INS at this stage.... especially when they are undergoing this change...
Consult attorney and post what you think and decided

I think I kind of have to inform the INS about change of employment, because I need to update my address, which is under the VSC.

Obviously, if I live in a different state 2000 miles from the old one, it must indicate to the INS that I have changed employment. If I don't tell them straight now, they must think that I have something to hide.

I didn't hire a lawyer for I-485. So just go ahead.

I will keep you guys posted.
