Any 485 approvals after 140 REDO

It looks like, although VSC has come up with a \'policing\' mechanism to catch cases that according to them require an I-140 redo, they haven\'t come with a \'justice\' mechanism for approving such cases, once they receive receive the necessary paperwork. I think there are people who have been waiting for almost 3 months ... maybe people should start keeping a separate tracker for such cases and make a combined effort to get a resolution.

I am one of them - maybe one of the early ones. I received 140 redo RFE in June. Replied in July. My lawyer received the new I140 approval letter on August 25th. I am still waiting for the 485 approval letter. I do not know what is the delay. The automated message did not change. It still says that a letter asking additional info was sent on June..... Calling IIO is a waste of time, but I do not know what else to do. The only question they always ask me is DID YOU REPLY TO THE RFE? When I give them the option that I am willing to send the documents again, they then say that they received some correspondence on July 25th. I do not what to believe.
Contacted congressman. I am waiting for an answer from them. Any suggesstions?

akp, i think you were pretty much the first one ... there was another guy, user id \'Mike Tyson\', who had also got an I-140 redo. For some reason, I\'vent seen a posting from him in a long time. I pray he has got his approval and hope he will post soon.

I think one of the things that we should do is call IIO\'s and ask them how VSC plans to handle such cases. If we make enough noise, I\'m positive someone will listen. It\'s atleast better than sitting mute.

There seems to be something amiss in this whole I-140 redo saga. So far I\'ve seen AKP\'s case take a long time, and IMHO it seems to be a case of broken link between the new I-140 case approval and the old pending I-485. I had also seen a case from Mike Tyson, whose lawyer advised him not to redo the I-140 so he just went back with an explanantion of the name change. Have not seen anything recently from him. I\'ve seen a couple (maybe three) approvals that were adjudicated within a month or less after the submission of the amended I-140. Then there were a bunch from teh Rapidigm and iGate crowd, and I haven\'t kept up with those. Now we have a couple more that were submitted in the last couple of weeks, and let\'s see how quickly they get approved. I am also getting ready to submit an amended I-140, and hopefully it will be done early next week.

As far as AKP\'s case goes, if, as he says, AKP has already aksed the IIOs to flag the case so that their supervisors can check it out, then my suggestions for the next course of action would be:
- Write to a congressman with all the details (as AKP has already done)
- Have the lawyer write a letter to the VSC director explaining the case and put some marking on the envelope so that it does get to the Director.

I agree with despo about the actions that need to be taken but maybe we can start tackling this issue at the grassroots level. Maybe each of us could call the IIO\'s once a week or two and ask them how VSC plans to handle the I-140 redo\'s? Do they need the approval or is the receipt for an amended I-140 petition is good enough and so on. Once these requests reach a critical mass, they\'ll have to look into such cases.

A word of caution though ...
as far as possible try to make a generic query and try not to give your case#. VSC does log your case# with phone calls and too many calls in your case record might irk some IIO. Lately, whenever I call, I don\'t give them my eac# ... just tell them I don\'t have it with me right now.

so, let\'s start this once a week exercise ... it might be a li\'l frustrating, but if more people chip in some effort, we could make them aware that a lot of people are concerned about this issue that has been dug up from its grave by VSC.

1.When did your redo I140 approved ..
2.After the redo I140 approval, did you sent the approval notice to INS ?
3.How long it took for I485 approval after the I140 redo approval..
