anxious for my I-485 approval.

I applied for both NIW and OR I-140 in Sep. 2003. I submitted I-485 application based on NIW I-140 in Oct. 2003. But in Sept. 2004, OR I-140 was approved first. So my lawyer wrote a letter to INS, requesting changing the initial basis of I-485 from NIW I-140 to OR I-140.

Since my spouse wanted to divorce and moved out last Spring, we submitted divorce lawsuit in December 2004. Supposed we will get divorced in June 2005. But in Jan. 2005, INS sent a RFE about our marriage status, as INS found we had been separated. I replied a letter telling the truth (My spouse had found another way to get PR ).

Just two weeks ago the NIW I-140 got approved as well after I provided new evidence (RFE in Jan 2005). But the I-485 is still pending.

I got fingerprint last April, but INS asked me to do fingerprint again two weeks ago.

Now I am anxious to know how soon I can get I-485 approved. Other friends who submitted I-140/I485 later than me and even got I-140 approved later than me, had got their PR half a year ago. I am wondering, can we change the I-140 basis of I-485 application? I once requested to change from NIW I-140 to OR I-140. Second, due to my spouse' separation I had been asked for RFE in Jan. 2005, but why I can't get I-485 approval after 3 months?

Take it easy

I have been in the same boat (waiting for gc) for over three years. Frustration, anxiety, anger, and other feelings are regular. Now that my gc has been approved, I find that nothing in my life has been changed. Before the approval, I could also work using EAD and travel using AP... So don't attach too much importance to it, otherwise you will feel at loss after approval :-)

I guess you can call the USCIS directly or ask congressman/senators for help if you think the USCIS messed up your paperwork.
