My attorneys applied for 140 even though, due to some mistake of DOL, labor approval was lost. But INS has obviously not approved 140 till they receive a duplicate from DOL. Now, thanks to the new law, the lawyers have also applied for 485. My questions are-
(a) Since the INS does not have the original labor approval, would that be a problem in getting the EAD and AP ?
(b) Again, since INS does not have original approval, would there be a problem in 485 approval since, from what I understand, 485 is dependent on 140 which is dependent on labor.
(c) What if I get laid off 6 months from now ? My 485 had been in process for 6 months, so theoretically speaking I should be okay to join another company but the problem is that my I-140 had not been approved and INS would not have had my labor...

AC21 does not apply for i140+i485 joint filers

From murthy chat, it seems AC21 ( 180 day rule ) doesnt apply for 140+485 joint filers.

Any way, i am not sure but from murthy chat transcripts some one posted this kind of question.
