I finished MS (computer science) in sept 2000 and joined a small company. My GC process was started in 2001. I am still waiting for Labor approval.
In 2004 my company was acquired by a bigger company. The current company is continuing processing my GC.
Yesterday I found out that my current company has a approved LC lying around with approval date of "February 2001". The approval has *exact* match in job skills, except two differences:
1. It is for B.E. degree (I have B.E. and M.S.)
2. It has 2 years of experience.
I think (1) is not a problem (correct me if I am wrong)
The problem part is (2). It was approved in Feb 2001, with 2 years of experience.
I started working in sept. 2000, which gives me 6 months of work experience in US till feb 2001. I worked for 1 year in India before starting masters (97-98), so I have total of 18 monts of experience. The company lawyer said we can do something about the 6 months missing experience.
Do I have a chance? If yes, do you have suggestions about how I can come up with 6 months of experience? Since I was on student visa, I was not allowed to work in US from 1998-2000. I was studying in india from 1993-1997, so I cant show work from that time. I have a 3 months internship that I did for a research lab in US during masters though.
Given all this, what can I do to show 6 months of missing experience?
Secondly,
1. What is the process to get GC using pre-approved labor?
2. How long does it take to find out if I DOL will let me use this pre-approved LC.
3. What is the timeline in case I can use this LC.
