Can I work on a part-time job with another company while my GC is pending? My current employer has sponsored my GC. My I-140 and I-485 are still pending, but I received my EAD 1 month ago.

Any feedback would be appreciated!

Yes, you can work parttime provided if you are completing your full time(40 hours) of job with your sponsoring employer, but still need to File taxes for this additional employment too.

Hope this helps..

Be careful since your I-140 is not approved the moment you use the EAD your H-1B will become invalid, then if I-140 is denied you will be immediately out of status.

Thanks Want GC Soon and hathwar for your feedback. hathwar, the point you mention applies to using the EAD vs continuing on H-1B. This brings up another question. My H-1B expires on June 13th and my H-1B renewal has not been approved yet. Looks like I have 2 options - stop working till the H-1B renewal is approved, or use my EAD to continue working. Based on your comments, using my EAD would lead to the same issue if my I-140 is denied. Please advise.

If H-1 B expires on June 13 and an extension has been filed and you have the receipt then you can still continue on H-1 B until a decision has been reached on that. U dont have to use EAD if you dont wish to

Ans: As long as you have filed your H1B renewal and its being processed, you can keep working on H1B itself. Incase if you have any problems in your H1B getting approved, then you can start working on EAD.

But once you use EAD, you are totally into immigrant status and if you want to come back on H1B, you need to do premium processing and get it stamped back in your home country and then re-enter US on your new H1B.

Incase if your I140 is denied, you become out of status the same day itself, then you need to the 2nd para and that depends on how much time is left on your old H1B period.

Hope this answers your question.

Want GC Soon :)
