Another one bite the dust i.e. me as my name suggest Humbledbychk :) ( I don't know what other reaction I have to give in case if you are wondering about smily face - I am out of expression )

OK a short Summary - Myself & wife filed N-400 on 10 Feb 06 under Chicago DO / NSC. Had FP on 31 march 06. Had Interview 9 June 06. Also I was taking Full Oath with arms to bear etc. Nothing unusval or special consideration. Also I had a pretty clean record, only one A file and no problem at all in last 10 years of legal status with each and every day accounted for under proper legal H1b or GC document. only visits last 5 years out of USA is one 4 month & other 3 weeks while maintining full residence in USA and all taxes paid as Residnet status.


My wife got cleared with "congratulation". She had a very wonderful joyful IO for Interview. To put it in perspective He was so good, you might have thougt he wants to sell you something.

In my case I had IO who was professional but no warmth flowing between us. It was quick. Came & pick me up. Gone through oath. had 6 questions / writing test in 3 mins. Went through the form in 7 minutes. I had one speeding ticket which I mentioned in form and I gave her ( voluntarily ) the certified copy of "everythins clear" like paid the fine , no arret, no court appreance etc.

Than she printed one form - It was FBI logo paper with my Complete name like First / Middle / last name in it. With my birth date, maried status, birth place. Asked me to verify the information is correct & sign on it. ( by the way my N-400 form mention the same name, it's not like it's different than the name she took on form ).

At this moment I started to feel my interview is on DETOUR. After signing the N-400 form for the interview appreance & on photos supplied - She handed over me the N-652 paper.

There it is - The decision can not be made verdict. My heart sank the same moment.

She told me my name check is still pending. I asked her specifically which is it - on which she says FBI namecheck. She said sometime it gets backloged and considering my interview was withing 4 months of filing date - sometime it takes time to reach the namecheck results.

She told me she is expecting the result in 3 weeks from now per her experiance of curent cases and the decision will be made. I told her that I heard the stories of Namecheck horror of 6-12 month waiting period - on which she smiles but did not give me any answer.

She told me that if I don't hear from after 3 weeks - I can write to her for follow-up. As in the 15 minutes it was over. I came out with heavy heart :(

After that 2-3 days I was very mad at myself ( not anybody but onmyself ) for having such a bad luck for sucjh a important issue in my life.

As I am a silent reader of this forum from last 3 months - I know the Publicus thred, 1447B or WOM option after 4 month. But still it sems for the time being pain is what i feel / expect to feel till this get resolved. I am gonna do my best not to let this takeover my life in other aspect such as family life / job etc. But words are easier than the action despite knowing all the thing the actual experience definitely makes anybody Humbled.

Now question for the Gurus -

1) My name is let's A B C ( A first , B middle, C last name ). My wife's name is V A C ( V her first, A my first as her midlle & C is same last name ).

As you see mine A B C
wife V A C

The A C ( my first & last name in her name ) is constant and her name got cleared.

Q-1 So why mine is pending ? does my middle B ( which is my father's name can make that much difference in namecheck ) ?


2) I have not read so far here in message board that even in namecheck - in interview they make u sign a new form of FBI with all your name ( which by the way is exactly same in N-400 form already given with all the same birth date details / married status etc ). Is this normal. if not what doe that mean.

Q-2 - Does it mean the IO realized that somehow my namecheck was not initiated in application process and by having this form they are going to initiate it ? while telling me that it's pending where as in reality they have not done it in the first place as in falling through the crack. - That is why the 3 weeks response time is the answer given for follow-up ?


Q-3 - Did I do anything stupid in interview ( i know you can not tell for that matter I can not tell ). But the important question is - Does the IO has discretionary power that DESPITE all the checks are clear / Civit / history pass - based on their feeling / vibe they get that can OVERRIDE the results and force to initiate a namecheck ? I mean I will consider it will be my faliure in the interview if somehow this is what it happended. ( I am hoping answer from expecrt to this question is - No, it does not happend this way - Don't take hard on yoyrself )

Friend...eventhough you said you will not let this takeover your life..but it seems that you are going crazy already.....just relax....no one knows and it is all speculation. Prepare your self to wait and if nothing comes up in 120 days..sue them.

It is not your mistake, just remeber this and it could have been worse, at least you have been called for an interview and you can legally sue them after 120 days.

buddy,did you read what exactly was on the paper that you signed(fbi),coz some io's have the dubious distinction of having applicants signing a waiver(i,e applicant acknowledge's tht he will not uscis/fbi)...anyways it does not matter if you sign tht waiver as the waiver is deemed negligeble by law...
but really interesting to see some one sign on fbi paper..what was on tht paper...???
 
i have never heard of anyone initiating a name check at the interview,i have a feeling it is some kind of waiver.
all your checks(name check or background check) they are initiated at the asc at the time when they record your fp and send it to fbi to process...
no way you could have skiped tht there...

I did make sure it's not a waiver. I mean there was no "small notes / legal langauges".

It was simple one pager form she printed from her printer.

It was Standard A-4 paper with FBI logo. If I remember correctly, The header reads - Federal Beauru of Investigation & Friendly Nations.

Below which just lie a Word table had my

First Name

Middle name

Last name

Birth Date Birth Country

Maried status - M


that is it.

Just at end of it, she draws a red ink line and ask me to sign above the line. No legal waiver langauge - I am sure about it otherwise I would have asked her specifically.

May be I should have asked her, But somehow I missed that in the confusion after her reply of Namecheck pending and conversation went on just like i described before. But when you go in front of them - at the back of mind you know they are GOD at least for that interview. So it's a fine line what to ask whitout sounding rude / challanging the IO authority.

I am in the same DO(Chicago) and same situation as yours. I has my interview on Jun,08, 2006. Did the officer gave you the 325 letter which states that your security check is pending? Thanks.

Nope - just a N-652 with "decision can not be made" and verbal response as "FBI namecheck pending" as said in first message.

By the way what is 325 letter ? - Is it Bio-graphic information form or something else ?

Please let us know what do you means by 325 letter. Also did they give you any timeframe ( verbal from IO ) like 3-4 weeks andd assurance like it is due to backlog and happened with many cases etc.

Considering that we both are under Chicago - if you don't mind - we can actually contact with each another by phone - if you feel comfortable.

If possible please outline your experience the way I described in the first post.

Before you get crazy over this issue, I suggest just forget about it for the next 3 weeks, and if you don't get your Oath letter, call the IO and you'll take it from there. ;)

Interview Done

Consider yourself lucky that you were interviewed/examined. USCIS is getting smarter about cancelling interviews for applicants whose name checks have not cleared. This way, you now have a basis for filing a lawsuit under 8 U.S.C. 1447(b).
 
N400er or Humbledbychk, where was your interview in Chicago? Was it on Jackson or South Clark Street? Any other suggestions for prepration to face interview at Chicago DO?

N400er - Could you please provide us with more detail on your interview session? Thanks much.

Once again what is 325 letter & if you could manage to write short experience of your interview process.

Especially the "15 minutes account / event" maybe helpful to know considering we are in same boat.

I had the same experience attending the interview on 15th June in Chicago. The officer was very cold and rude.Initially Officer congratulated me but after checking the computer, took his words back. I was issued N-652. I was given a general pre-printed letter explaining that the necessary security check need to be completed by FBI. Once that is completed, they will make their decision. I felt as if someone was doing me a favour!!

Thanks Suzy977. I read somewhere that some people got oath letters within couple of months of decision cannot be made due to background check outcome. Have you read or seen postings to this effect.

Yes, I've seen posts where some lucky guys got their Oath letters after initially they were told that the name check wasn't completed.
