Hello everyone,
long story short:
I was doing research in H1, got residency spot at university place, their "politics"did not allow to continue my H1, so I took the ECFMG J1.I moved to a better place and they have lost a couple of resident along with myself, now they kept another foreign resident that was on OPT, and they did him an H1B, looks like the politics of the institution suddenly changed.
Should I initiate any legal issues against them? What's your opinion? Because now I am stuck with my J1 and to get a waiver I will have to spend a lot of time and money.
Any advice? Is that discrimination? any good lawyer that you can recommend?
thanks and GOOD LUCK!

finish ur residency and move out of that place peacefully. say u win the legal battle against the hospital u are not going to get back ur H1 or 2 yr HRR on J1.
Blame it on ur destiny.

Thanks ferdie
I am not in that place any more, I've moved to a better program.
Say I win, will I get enough to pay all the process of the J1 waiver?

What exact legal argument would you plan to bring forward to support your claim ? Someone else was apparently in a better negotiating position than you were and managed to get an H1 out of them. It is like going back to the car dealer after you notice that your neighbour got more 'cash-back' 1 week later.

Medicine is too small of a world to go around and sue ex-employers over b#(*()t like this. 10 years down the line you will still need your internship residency directors goodwill when the hospital credentialing committee asks for references. If you start suing people, you will notice that promising job opportunities will suddenly evaporate after the reference check.

You signed on that DS2019 knowing what it would entail. No live with it.
