an urgent question on AP

Hi,

I am planning to travel very soon. I need to travel twice in the next two months out of U.S.

I applied for multiple entry advanced parole in Dec. 2003. It was approved on April 16 2004. I got three copies of the same thing. My lawyer told me that I only got single entry approval. I looked at the notice, and don't see anywhere saying single or multiple entry besides the standard printout. Since my lawyer is very inexperienced, I can't really trust his claim.

I saw on the approval notice: "Contigent upon the appliant's prima facie eligibility, this authorization is valid for multiple applications for parole into the United States during the validity of the parole authorizaiton noted above." Does it mean that it is for multiple use?

Thanks a lot in advance. I need to know this to decide whether I should travel on AP or on H-1B.

I am not sure what others have to say, however if you use your AP then your H-1B would be nullified and thus forcing you to use EAD for work.

I am not sure you want to get sucked into issues of extending AP/EAD. Nowdays AP is taking 4 months, and EAD is taking 3+ months.

Therefore, keep your H-1B and use that to re-enter USA.
 
Should not be a problem

I am assuming that you are already on EAD and not on H1. If you are on a H1 with enough validity, please use H1 to enter.

On the other hand if you are already working on EAD, the AP that you have should be OK for multiple entry. Make sure you carry all three copies with you and a few copies for good measure. Also carry copies of you 485 receipt notice, 140 approval notice (if it is approved, receipt notice if not) and any others you see fit. Present just one AP document when you go to the counter. They will send you to special processing line. They will stamp your AP document and your I94 after verifying things in the computer. The stamp will read something like : Paroled until......

The same stamped AP document can be used for multiple entries. On the other hand, they may ask you for other two copies of AP. When asked, produce them. In the old days, they used to ask for the copies since they need to keep a copy with them. These days it is all computerised. If you got a AP doc with your photo printed on it as opposed to a pasted passport size picture, then you have the new one. Do not worry, AP can generally be used for multiple entries until the expiration date printed on it.

after how many day's of your approval of AP you got your AP in your mail. My case was approved on 22nd April and still not received AP in mail.
 
I do not think H1B is nullified if you use your AP. You can sontinue to work on H1b and travel on AP. This is as per the advise of my lawyer.

You can use same copy of the AP for multiple times .
It is good and easy for them, dont furnish unless they request you for another copy. As for as i know AP is valid for multiple times

My approval notice was sent to my lawyer within 10 days after the approval.
