Hi Ron; just has a bad experience at the LA office with AOS. The officer noted that I had left the country for two weeks in March 1999, after I had filed for AOS without AP. She said this meant by I485 had been abandoned and she couldn\'t approve the case, and I would need to reapply. I had a valid R1 (religious worker visa) at the time and reentered on that. I assumed that that was OK, but apparently not.
When my visa expired in June 1999 I filed and received AP and EAD and they have been current since then, and I have used the AP several times. But it would seem that I was technically overstaying my R1 since June 1999 but receiving documents as if my I485 was still OK, right?
So my question is will my filing I485 again just result in a refusal again when they come to the interview because I was technically here illegally?
