Hi,

A few days ago, on the local community news, I heard that USCIS is now denying I-130/I-485 of illegal immigrants who married to U.S. citizens. Since the local newspaper was notorious for misleading contents, I didn't pay much attention. However, today, I also heard from one of my friends saying that one case actually was denied like that.

Is USCIS now officially denying I-130/I-485 cases of illegal immigrants who married U.S. citizens??? When did it change like that? Anyone who knows what is going on???

I heard that too, not sure if it is true or not.
there was a case that I heard about few months ago in Baltimore where a man was denied a case like that. I don't know the details though.

If person EWI or got criminal record then why not? Because we don't know ANY details about the case it's impossible to say WHY it was denied (being illegal may be just a small addition to bunch of other problems).

I wonder if it depends on how you came into the country and how long you've been married.
I haven't heard anything of the sort, but would not be surprised.

I was thinking the same thing.
Those people probably just say they were denied because they were illegal but there has to be more to the story.

There is a technical difference between illegals(EWI) and illegals(overstay). The law allows overstays to file i-485 but not EWI. It also allows both groups to file i-130. Those being are most probably being denied due to other reasons
