Hello All,
I'm a 485 applicant and have a valid EAD. I was on H1-B(valid until June 2006) until my company's office moved from NH to MA. My Immigration dept. said that they'd have to refile H1B as the metro area was different for the new location and since I had a valid EAD, asked me to use EAD to work. When I asked my company's Immigration people about refiling I9 to reflect EAD as the document to prove work eligibility, they assured me repeatedly that it was not necessary.
I am currently on business out of the country and when I asked them about I9 again recently, the Immigration department told me that I9 is required only when I'm physically in the US. I really don't see why they don't want me to refile I9. But they seem pretty adamant about it.
My question is: Am I in trouble because I didn't refile I9? Are there any other issues I should be aware of when moving from H1b to EAD?
