An Analysis for AC21 days law

Difficult to interpret for those not accustomed to reading legal articles

The article is very informative and well reasoned. It must be noted that much of the article is argument about how the law should be interpreted, not statements regarding what is the correct interpretation. Since there are no implementing regulations for AC21, very little in the article is definitive. Many of the arguments are good but it must be recognized that nothing stated has any real legal significance and a person who relys on any of it could end up in big problems if INS takes a different interpretation.

I agree that very little in this article is definitive and it should not be considered a fact.
When such arguments come from a reputed lawyer, in the absence of any real regulations, it is my view that those that are in a fix situation need to know possible scenarios that could happen if they have to make a job change decision.

I think such interpretations do present the view INS has historically taken and my intention is to invite people who have been under such circumstances to present their view as to what decision INS made in their case.
