Here is my situation:
I was working for Total Care Company Inc from June 2006 and my I-140 petition was filed in NSC on Dec 18th 2006 with the approved labor. On Oct 1st 2007, Total Care Company merged with Droisys Inc and I became an employee of Droisys Inc from Oct 1st 2007.On April 7th 2008 the Total care company received a RFE on Ability to Pay from NSC on my I-140 petition.On May 8th 2008 the RFE response was sent and it is pending till now. Now the TAX ID and the Company name is changed for me from Oct 1st 2007. So do we need to file an amended I-140 petition with the new employer Droisys Inc in this situation. Please help me in this issue.
