Amended I-140(Jim Mills Pls. respond)

My 485 was filed thru\' Company A in 09/01. Company A got acquired by Company B in 12/01. There was a layoff and I was told that I\'ll lose my job. I was able to convince the new company to keep me aboard till 03/02 when my 180 days would be up. I was told that they would be filing for an amended I-140. I am planning to quit and join a new company in May. My lawyer says that because I am going to use the AC-21 I don\'t need to file for an amended I-140.

Any responses appreciated. Jim Mills would love to hear from you on this one.

Yes the same attorney will represent me. Would that make a difference?

The reason I posted this question was the reason the attorney changed his opinion on the amended I-140 after I decided to change employers.
I am still unclear on why the amendment is not needed/needed.

Should we be informing the INS of the change in employement? I hear conflicting views on this. Some say proactively informing would delay the case.
