Ref: For a pending I-130 for married child of a USC.
The marriage is ending and headed towards divorce. Can the marital status be changed on I-130 to single from married or does a new I-130 needs to be filed?
You can only change it when the actual marital status has changed, and you have a divorce certificate to show that. Depending where it is in the process, at that stage notify either USCIS or NVC. Case type will be changed from F3 to F1.
