Am I Safe Re-enter Usa With My Situation ????

Hi Guys .. Im Planing To Apply For Ap As No Decision Made Yet From Uscis .... Here My Situation :

I Came To United States On Oct 2005 With B2 Visa Valid Till Oct 2006... May 2006 Got Marreid To Usc , July 2006 Apply For I-130 .i-485 ,i-765 On Sep 2006 Got My Ead , Interview Nov 2006 . No Decision Made At The Interview The Officer Told Us That Will Receive Lettre By Mail Within 90 Days . And Its Been 107 Days By Now ... We Didnt Hear Anything ....EVEN NO ONLINE UPDATE ... So Im Planing To Go Home For Couple Of Weeks ,, If I Get Ap Will I Be Safe Enter The United States Or There Is Chance For Return Me Back .. Im Really Scared .. Coz I Heared Alot Of Storeis Happened With People Who Have Ap .... So Please Advice Me

You need to make sure you have your AP and also you may want to do a info pass to see whats happening with your case...Good luck

You don't have to worry about the 3 or 10 year ban. Even though visa expired you were not out of status at any time. Once you married US citizen and filed, you are "status pending". You need your AP to travel and re-enter. Of course as you already know that is for you to be able to travel while adjusting status. I would wait till I get the green card. Try making an Infopass to see what is going on with your case.
