Hi, there,

Got H1b visa on July,2002, valid up to May, 2003. Currently in the process of H1b transfer. Need H1b transfer receipt from INS to start new job legally.

Question is :

If my paycheck is terminated before receiving H1b transfer receipt, does that mean my H1b is volid too, then I am out of status ? can I still stay in US legally without working ?

It's depend on your receipt date of your h1 transfer, usually if the gap is too small, INS won't notice otherwise they will issue REF in your h1 transfer process.

can I still stay in US legally without working ?
Legally no, but once you get your h1 receipt may be, consult your lawyer.
