Hi,

I was going thro\' my old H1s and found that RD (11/12/98) on my extension application is exactly same as expiry date i.e. 11/12/98, of my old H1. And I had gotten extension approved after copule of months. The new extended H1 had validy from 2/7/99 (I guess this is my ND) to 1/1/00.

So was I out of status between 11/12/98 and 2/7/99 ?
Also, if RD is same as expirty date of previous H1, is that OK ? OR it has to be BEFORE expiry date ?

Currelntly I am waiting for my 485 approval. (PD 2/97 RD 12/99 ND 01/00 EB3 India)

Any comment would be appreciated.

I am afraid that technically if the period between H1 is more than a month then it is considered out of status. But at this stage do not contact INS or initiate any application to INS but instead talk to a lawyer to prepare to answer any RFE based on this issue.

Don\'t worry, you are fine. As long as your application for the extension was received before the previous one expired, you are not considered out of status in the interim. So relax.

Did you apply for the H1B Extension before your earlier H1B is expired?
But any case talk to Lawyer before talking to INS.

yes, I applied before expiring date but i think Ins received it on same date of last H1 expiring date ( i.e. last H1 was valid from 11/12/97-11/12/98 and ins received extention papers on 11/12/98).
