Am I In Trouble?

Would greatly aprpeciate if some knowledgeable people or professionals could take a look at my age:

I was married in 1997 to an American. Marraige was a mistake right from the beginning. In 1998, we went for the first interview but were then asked to go home and request another document (divorce papers) from the court regarding my wife's previous marriage. The document we sent was not acceptable as the date on it was handwritten, and the interviewer told us it was supposed to stamped or machine printed. While waiting for the court to issue another document, the marriage was already in a fragile state. We filed for divorce so that we could get on with our lives. Marriage was so bad that whenever we had a fight, she would threatened to withdraw the petition anyway. It was so bad I had to go for counselling alone as she refused to do it with me. It was at this point that I realized my marraige was a lost cause and I refused to be held hostage by her. I was just so glad to be out of it and returned to my country.

In fact, I was the one who filed for the divorce, and prepared the paperwork to withdraw the petition. I received an INS notice in 1999 confirming that my petition was DENIED due to WITHRAWN status. No deportation proceedings, no investigation or anything since I had gone home voluntarily as advised by my lawyer then.

So I returned to the US in 1999 to continue with my education, and now have a Labor Certification and Green Card process going on. Do you forsee any trouble with my past petition when it comes to adjusting my status based on employment in the near future? What can I do about it?

I see no problem in your case since you did not violate any immigration laws and went back. Also since you were allowed back in the US by the INS and on your I-94 the officer at the POE did not write no aos means INS has no issues with you.

I don't see any trouble. Actually family based cases and employment cases are different and even people can have both type of cases at the same time.
