Hi all,
I just found my husband (american) filled N/A on the Prior wife (G325A and I130) when he sent the application, but he did married before(20 years ago),am I in big trouble?
We already paid 88usd and 404usd, my case will change CR1 to IR1, now just wait to send 230 form ,I-864 and other support papers.
They approved I130 without asking us send more papers.
:(
I don't want wait until my interview time to explain this problem, but what can we DO now?
Thanks in advance

You are not in big trouble. Its your husband who filled out those forms so if there is "big trouble", it would be his. You probably will have to wait for the interview to address the issue. This is not a material change which would have affected the petition otherwise.

See instructions from the USCIS Training Manual below

A petitioner must establish eligibility at the time of filing. The petition may not be approved at a future date after the petitioner becomes eligible under a new set of facts. Therefore, a petitioner may not make a material change to a petition that has already been filed in an effort to make an apparently deficient petition conform to Service requirements.

Alternatively you may type up your explanation on a sheet showing the Alien number you were provided with and mail it to the appropriate address.

ananga73 ,thanks so much for your fast reply.
I know it's his mistake, but this will effect my visa.I do not know how they check his background, they should find out this problem and ask us to provide more papers ,instead, they approved our I 130.
I really don't want them think I just got know he married before when interview time, I knew my man more than 4 years ago and we married for two years now, he did not lie me about this issue, but maybe they think he does.
We are going through Electronic Processing Program‏ , the next step we need do is email NVC 230 form ,864 form and other papers,I'm thinking when we email these papers, email them the mistake statement togather with my husband's dirvorce paper.Or I should just wait when interview, show them the statement.

It is good to be proactive about it, if you can notify them before the interview together with his divorce papers. You need also to give a good reason for the mistake. Like I said earlier, this is not a material change and should not like affect the previously approved I-130.

Good luck!

I feel better now. Even that way will delay my interview time, that's ok. I think the best reason will be that's 20 years ago and that marriage did not last long at all(less than one year),anyway, this will be my husband's reason, he need get this sovled.
Thanks again.
