am I going to have problems?

Here is my case. My I-140 was filed last month. The problem was the labor certificate I used was for a person who was laid off. The labor was approved in June, 2002. I am a perfect match for the labor certificate. However, because it has been 9 months since the labor certificate was approved, my lawyer was concerned INS might question it, or, though unlikely, deny it.

Anyone had this experience before? Does anyone think my I-140 will have problems???

dont think its a prob.
u shld file 140 within a year from ur labour approval.
since u hv done within 12 months (u said after 9 mo.)
so it shld be fine.

Actually, an LC is valid indefinitely. It does NOT expire in a year and there is no requirement that it be used within a year. INS can question if a job remains available, and I guess a 10 year old LC would be challenged, but there is no set time limit.
