I had a H1-B visa for about 1 year till July, 2002. I was laid off in July,2002. I then joined another company with a month of this lay off on a TN. I have been on a TN ever since then till today. Also, I have never been out of USA for more than 6 months at a time.
Will the 2006 H1-B cap apply to my case?
Also, besides my old H1-B, what will I need to prove to USCIS that I did not leave USA for more than a year or they have exit/entry records for me in their computer system and I do not need to worry about proving this?
Any help on this would be greatly appreciated.
