Hello Everyone,

I need help guys.. Let me explain my profile.
Bachelors(4yrs) + Masters in US(2yrs) + Experience In India 6months + Experience in US 8months till date. I'm on H1B.

Am'i eligible to apply for LABOR under any EB2/EB3. If yes what are my chances of getting labor audited. If No how much experience do i need to have to file under EB2 or EB3.

Help me out Guyssss...
 
You're most likely eligible for EB3 (it requires a BS-equivalent, which with the US masters you probably have), as to EB2 (which requires MS or BS+5) - it's trickier, there are additional conditions to be met: 1. the job must require MS, 2. It should be a different position from which you had prior to MS. I.e.: If you were hired to the position that requires MS before getting it - it's not valid, or if you were hired to a position that normally doesn't require MS but for you for some reason it does - it would probably not hold as well for EB2.
